What is a Provisional Patent?

·      A provisional patent gets you a patent pending number and allows the term “Patent Pending” to be applied from the date of filing.

·      A provisional patent protects your invention for One year from filing date.

·      A provisional patent has a Filing fee of $100.00 to  the USPTO for small

      entity status, or individual inventors ($200 for non-small entity status).

·      A provisional patent application is a U. S. national application for patent filed in the USPTO under  35 U.S.C. §111(b).

·      A provisional patent provides the means to establish an early effective filing date in a non provisional patent application filed under 35 U.S.C. §111(a). -- see Provisional Patent Application

·      A provisional patent cannot be used with Design Patents.

 

Why would I use a Provisional Patent?

·      It gives you real, legal Patent and Trademark Office protection for One year allowing you to see if your invention is worth the cost of a full Utility Patent before you spend the money. (usually between $3,000-$15,000)

·      It enables you to quickly and easily file a patent application, allowing you to talk to Investors, Manufacturers, Licensing Agents, etc. with the

     security of knowing its “Patent Pending”.

·      It has a lower filing fee of $100-$200 instead of the $1000’s for a full non provisional patent.

·      If your invention is worth investing in a non provisional patent, a Patent Attorney can use the Provisional Patent information to complete and file a full Utility Patent within the one year provisional period.

·      It can potentially add up to one year of patent protection for an invention when followed by a formal non provisional patent application.
